I decided to close the year out with a summary of new Criminal Laws enacted by the NY Legislature for 2011. My favorite: The New York State Child Passenger Protection Act, commonly referred to as Leandra’s Law The law was enacted in response to the October 2009 accident when Leandra Rosado was thrown from a car that was driven by a drunk driver. Let’s make sure nobody ever gets into a vehicle after they have been drinking! David Lesch, Esq.

I ended my “family law” series with the dreaded “D” word: Divorce. If you live in New York, you might be surprised to know that the state has finally adopted a no-fault divorce policy. This means that a couple need not prove any wrongdoing or abuse to file for divorce in a court of law. many though believe that the NY legislature did not think this change all the way through. This morning I filled in for Daren Jaime as host of the morning show “Open”. I did manage to continue my “family law series”, albeit briefly, discussing “abuse and neglect” as it relates to our youth. You have a moral, and sometimes legal responsibility, to report any hints of either to the Administrationn for Child Services, or your local police precinct. Please do. Every child needs to know that society is looking out for them.

It was a pleasure meeting my guests on the set today: Kellie Phelan from “Hour Children”, Quenia Abreu from “NY Women’s Chamber of Commerce”, and Wayetu Moore and Juan Rios of “Highbridge Community Life Center.” Thanks also to David Lehman for partnering with Highbridge and advocating for a smoke free Bronx!

It was nice to see Councilman Vacca at the BronxNet Studio this morning. As promised, I continued my “Family Law” series, focusing on the topic of “Adoption”. There are a few different ways to bring a child into your life, or confirm your legal relationship with one, through adoption. The best advice I can give, get an attorney that specializes in the area! He or she will guide you through the process and let you know whethere you are better suited to pursue an agency or independent adoption. David Lesch Esq.

A prenuptial/premarital agreement is a written contract created by two people planning to be married. The agreement typically lists all of the property each person owns, as well as their debts, and it specifies what each person’s property rights will be after they tie the knot.
